NO PURCHASE NECESSARY TO WIN Your entry constitutes your full and unconditional agreement to and acceptance of these Official Rules and Regulations. ELIGIBILITY FOR SWEEPSTAKES The LA CURACAO Weekly SMS Sweepstakes (the 'Sweepstakes') is open to all residents of California and Arizona, who are at least 18 years of age or older who are subscribed to LA CURACAO's SMS Alerts. If entrants are residents of a jurisdiction that deems them to be minors, they must have the permission of their parent or legal guardian to participate in the Sweepstakes. Employees of ADIR International, LLC., LA CURACAO, their respective parents, affiliates, subsidiaries, advertising and promotional agencies, any other prize sponsor, and any entity involved in the development, production, implementation, administration or fulfillment of the Sweepstakes (all of the foregoing, together with Sponsor, collectively referred to as "Sweepstakes Entities"), and the immediate family members (parents, children, siblings, spouses) and persons living in the same household as such individuals (whether related or not), are not eligible to participate or win. ODDS OF WINNING SWEEPSTAKES Odds of winning depend on the total number of eligible entries received. SWEEPSTAKES DRAWING All valid entries will be entered into the prize drawing, which will be held weekly. The potential prize winners will be selected via a random electronic drawing from among all eligible entries received. Prizes may not be transferred or substituted except by Sponsor, who reserves the right to award a substitute prize of equal or greater value. CLAIMING A PRIZE FROM THE SWEEPSTAKES Potential winners (if residents of a jurisdiction that deems winners to be minors, their parent or legal/guardians) will be notified by telephone. If a potential winner cannot be reached after a reasonable effort has been exerted, if he/she is found to be ineligible, if he/she cannot or does not comply with these Official Rules, or if his/her prize or prize notification is returned as undeliverable, potential winner will be disqualified and an alternate potential winner may be selected at Sponsor's sole discretion. Potential prize winners (their parent/legal guardians if they are residents of a jurisdiction that deem them to be minors) may be required to sign, execute, have notarized, and return an Affidavit of Eligibility, a Liability Release, (where legal) a Publicity Release and any other documentation that Sponsor requires (collectively "Affidavit/Release") within five (5) days after receipt by potential winners or such potential winners may be disqualified and alternate potential winners will be selected. GENERAL CONDITIONS FOR SWEEPSTAKES By opting-in to specific offers from any of the Sweepstakes Entities, entrant's entry information will be subject to their respective privacy policies and terms of service and entrant agrees to receive additional email communication from those companies. If, for any reason, the Sweepstakes is not capable of running as originally planned, or for any other reason, Sponsor, at its sole discretion, reserves the right to cancel, suspend or modify the Sweepstakes or any portions thereof (including, without limitation, these Official Rules and/or the prizing to be awarded hereunder) and conduct the drawing from all salvageable eligible Entries received prior to (or if applicable, after) the cancellation, suspension or modification if any, or in a manner that is fair and equitable as determined by Sponsor and/or Sweepstakes Entities. In case of a dispute over the identity of the entrant who submitted the winning entry, the authorized account holder of the cellphone number associated with that entry will be deemed the entrant. The "authorized account holder" is deemed the natural person who is assigned to the cellphone number by a wireless communications service provider, or any other organization that is responsible for assigning cellphone nu,bers for the domain associated with the submitted cellphone number. Said entrant must comply with these Official Rules and, at Sponsor's sole discretion, may be required to provide proof of ownership of the cellphone account. LIMITATIONS OF LIABILITY The Sweepstakes Entities are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) any technical malfunctions of the telephone network, computer online system, computer dating mechanism, computer equipment, software, internet service provider; interruption or inability to access Sweepstakes or any Web site or online service via the internet due to hardware or software compatibility problems; any damage to entrants (or any third person's) computer and/or its contents related to or resulting from any part of this Sweepstakes; any lost/delayed data transmissions, omissions, interruptions, defects or any other errors or malfunctions; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Sweepstakes or receipt or use or misuse of any prize. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant's sole remedy is another entry in the Sweepstakes, provided that if it is not possible to award another entry due to discontinuance of the Sweepstakes, or any part of it, for any reason, Sponsor, at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In event that production, technical, or any other reasons cause more than stated number of prizes as set forth in these Official Rules to be available and/or claimed Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims. DISPUTES Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court, Central District of California or the appropriate California State Court located in Los Angeles County, California U.S.A.; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
